  1. Privacy Notice

    This Privacy Notice (“Privacy Notice”) sets out how Digital Nasional Berhad (“DNB”) and its related or associated companies (collectively “we”, “us” or “our”) processes personal data that we may collect from you including when you apply for a job with us via DNB’s career portal or other DNB related pages providing information on career opportunities with DNB.

    By providing your personal data to us, you agree and consent to be bound by this Privacy Notice. You also confirm that all personal data provided by you is accurate and complete, and that none of it is misleading or out of date. You will promptly update us in the event of any change to your personal data. You are required to ensure that your parents or legal guardian consent on your behalf to be bound by this Privacy Notice, if you are under the age of 18.

    We may modify this Privacy Notice at any time at our sole discretion, and such modification shall be effective immediately upon posting of the modified Privacy Notice on our website (https://www.digital-nasional.com.my/privacy-notice) You agree to review this Privacy Notice periodically to be aware of such modifications, and you accept and consent to be bound by the modified Privacy Notice.

    We are committed to processing your personal data in compliance with the Personal Data Protection Act 2010 (PDPA) and the laws of Malaysia.

  2. Types of Personal Data

    Personal data” is defined under the PDPA to mean data, whether true or not, about an individual who can be identified from that data, or from that data or from other information to which an organisation has or is likely to have access.

    To the extent that you have provided (or will provide) personal data about others, you confirm that you have explained to them that their personal data will be provided to, and processed by, us and you represent and warrant that you have obtained their consent to the processing of their personal data in accordance with this Privacy Notice.

    Your personal data may include, but is not limited to:

    1. All Users
      • your information – such as name, NRIC or passport number, date of birth, gender, nationality, race, address, email address and contact numbers (landline and/or mobile)
      • any other information that identifies you or makes you identifiable
      • recording of your images via CCTV cameras when you visit our premises
    2. Job Applicants
      • your information – such as name, NRIC or passport number, date of birth, gender, nationality, race, address, email address, contact numbers (landline and/or mobile) social network details, marital status and details of your family members and next of kin
      • education information – such as your secondary and tertiary education, including but not limited to degrees certificates, transcripts, field of study(ies), overall results and the commencement and ending date of education, and any other qualification
      • employment related information – such as details of your employment history, your job title or position, your employment location, role description, date of employment and date of end of employment, employment references, notice period to tender resignation, details of any criminal convictions that you declare or criminal background screening (where relevant and permitted under applicable law), bankruptcy history, conflict of interest declarations, political declarations
      • financial information – such as salary history, other benefits, company allowances, bank account details, personal reference number with regulatory bodies including but not limited to the Inland Revenue Board for tax deduction, Employee Provident Fund for employee and the employer’s contribution to the retirement fund, Social Security Organisation (SOCSO) for social security protection to employees and their dependents through the Employment Injury Scheme and the Invalidity Scheme
      • sensitive personal data - such as information as to your physical or mental health or condition, and your religious beliefs
      • any other information that identifies you or makes you identifiable – such as those shared in your resume or curriculum vitae
  3. Sources of Your Personal Data

    We may collect your personal data from, amongst others, the following sources:

    1. All Users
      • you – such as when you interact with our website, submit information to us, contact us for information, visit our offices, events or other premises or take part in any of our online or digital initiatives
    2. Job Applicants
      • you – such as when you use or interact with us on our website, submit information to us, contact us for information or apply for employment
      • third parties or external agencies – such as your referee, authorised recruitment agencies, education or financial institutions, credit reporting agencies, or any other party or agency for purposes of recruitment and assessing any application for employment
      • such other sources – such as where you have given your consent or where otherwise lawfully permitted
  4. Purposes of Processing Your Personal Data

    We may process your personal data for, amongst others, the following purposes (collectively “Purposes”):

    1. All Users
      • for internal record keeping, administrative, governance and compliance purposes, including but not limited to auditing, data analysis, database records, statistics, risk management, budgeting and conflict of interest reporting
      • to provide you with information that you may request from us and/or to communicate with you
      • to maintain, improve or enhance the user experience of our website
      • for any contractual obligations entered into by us
      • for purposes of investigations, prevention and detection of crime
      • for purposes of, or in connection with, any legal proceedings, or for the purposes of establishing, exercising or defending legal rights
      • for any purposes as set out in our Terms of Use or in any agreement or policies
      • for any other purposes that is required or permitted by any law, regulations, guidelines and/or relevant governmental or regulatory authorities
      • for any other purposes that are incidental or ancillary or in furtherance to the above purposes which are not specifically mentioned herein
    2. Job Applicants
      • for any background checks including but not limited to education check, previous employment records check, reference check, bankruptcy history and/or criminal background screening
  5. Disclosure of Your Personal Data

    Your personal data may be disclosed to relevant third parties (within or outside Malaysia) including but not limited to:

    1. All Users
      • third parties appointed by us to provide services to us or on our behalf such as those processing personal data on our behalf
      • governmental or regulatory agencies to comply with statutory, regulatory and governmental requirements, including law enforcement agencies, government departments, statutory authorities and industry regulators
      • any person to whom we are compelled or required to disclose to under law or in response to a competent or governmental agency
      • other companies, organisations, and/or service providers to carry out any of the Purposes
    2. Job Applicants
      • any credit reporting agencies/debt collectors
  6. Transfer of Your Personal Data to Places Outside Malaysia

    We may transfer your personal data to places outside Malaysia, including but not limited to transfers to our offsite facilities, our service providers and strategic partners or servers and/or related equipment, located outside Malaysia. You consent to us transferring your personal data to places outside Malaysia in these instances. We may also transfer your personal data to places outside Malaysia where permitted by law.

  7. Your Right to Access and Correct Your Personal Data

    You have the right to request access to personal data in our possession, or to correct such personal data. You may make such request by contacting us using the details set out below.

    We may decline to comply with your request, but we will notify you of the reasons for not being able to so.

  8. Exercising Choices Over Your Personal Data

    You may exercise your choice to limit the use or the extent of use of your personal data and personal data relating to other persons who may be identified from that personal data, subject always to our contractual rights and/or our rights and obligations under relevant laws and regulations.

  9. Consequence of Not Providing Your Personal Data

    Where indicated (e.g. in application forms), it is obligatory to provide your personal data to us to enable us to process for the Purposes. Should you decline to provide such personal data, it may, amongst others, prevent us from communicating or continuing to communicate with you or affect certain aspects of your employment with us. It is also obligatory for you to provide DNB your personal data if you enter any of our premises or attend any of our events. Should you disagree to provide such personal data, we may refuse your entry.

  10. Cookies

    Cookies are packets of information stored in your computer or device which assist your website navigation by customising site information tailored to your needs. The cookies will not collect personal data that could be used to identify a specific user. You may configure your browser to notify you of cookies and to prevent installation of cookies on your computer.

  11. Contact Us

    You may submit your complaints, request for access to and/or correction of your personal data, request to limit the processing of your personal data and/or make any inquiries regarding your personal data by emailing info@digital-nasional.com.my.

  12. Conflict

    In the event of any conflict between the English and Bahasa Malaysia version of this Privacy Notice, the English version shall prevail.
